The principles of proportionality and subsidiarity play an important role in the deployment of a corona app. These two principles have a prominent place in human rights law and have also been incorporated into for instance the General Data Protection Regulation. They are an important consideration for judges in assessing whether there has been an infringement of human rights. For AI (another hotly debated technology) there has been considerable discussion in recent years, and the conclusion for many was that an AI application could be seen as proportional if the infringement that the application makes on a human right or public value, is in balance with the social return of that application. That means an AI application is an alternative if no other application is available that produces the same result without infringing on human rights or public value.
